  1. The TY Danjuma Foundation (TYDF) provides payment services to prospective donors, and these Terms and Conditions (T&Cs) govern their use of these services. The governing language is English, and users must form a binding contract with the Foundation and not be barred from receiving services under the applicable jurisdiction. 
  1. The Foundation and its licensors own the website’s intellectual property rights and materials, including text, formatting, graphics, animation, tools, commercials, music, video, articles, sound, copy, trade names, logos, and other materials and information. Users are not granted any rights, licenses, titles, or interests to these intellectual property rights. 
  1. The Foundation grants users a non-assignable, non-exclusive, and revocable license to use the software provided as part of their services in the manner permitted by these T&Cs. The services are protected by copyright, trademark, and other laws of both Nigeria and foreign countries. Users are not allowed to use the Foundation’s name or any of the Foundation’s trademarks, logos, domain names, and other distinctive brand features without written permission from the Foundation or a third party. 
  1. Feedback, comments, and suggestions provided to the Foundation and its services are voluntary and will be used as needed without obligation. The Foundation makes no warranty that the website and services will meet user requirements or remain free from interruption, bugs, inaccuracies, and errors. 
  1. User use of the services provided through the Foundation’s website is at their own risk, and they alone are responsible for any damage that results in data loss or damage to their computer system. No advice or information obtained from the Foundation or its services will create any warranty or condition not expressly stated.
  1. To use the Foundation’s payment services, users must enable 2-factor authentication (2FA) as an extra layer of protection, and they must configure their information technology, computer programs, and platform to access the services. They must not attempt to gain unauthorised access to the services, computers, or databases, and must not misuse the services by introducing malicious or technologically harmful materials.
  1. The Foundation’s Terms and Conditions (T&Cs) outline the terms and conditions for users, including limitations of liability, indemnification, and data privacy. The Foundation is not liable for any direct, indirect, incidental, punitive, consequential, special, or exemplary damages arising from its website or services. Users agree to indemnify the Foundation and its affiliates, staff, and representatives against any losses, damages, costs, liabilities, and expenses resulting from any breach of these T&Cs.
  1. Breaching these T&Cs may result in various actions by the Foundation, such as suspending access to the website, prohibiting access, blocking computers using IP addresses, contacting internet service providers, or bringing court proceedings against users. Cookies are used by some links on the Foundation’s website to identify users and customize their services. Users can disable cookies to limit their ability to use certain services on certain websites. 
  1. The Foundation is committed to protecting user privacy and is compliant with the Payment Card Industry Data Security Standard (PCI/DSS) requirements. Personal information processed by the Foundation is in compliance with all data protection laws in the territory, including the Nigeria Data Protection Act 2023 and applicable regulations. The Foundation maintains a Privacy Notice that provides an overview of personal information collected about users.

The Foundation’s T&Cs are governed in accordance with the laws of the Federal Republic of Nigeria, and users submit to the non-exclusive jurisdiction of courts located in Nigeria to resolve disputes. Termination of an agreement with the Foundation is possible by ceasing to use the Foundation’s services on the Foundation’s website. Service providers linked to the Foundation’s website may suspend or terminate their services at any time for any reason, including breach of these T&Cs, fraud, or impersonation.
  1. The Foundation reserves the right to change, revise, or modify these T&Cs from time to time, and users agree to be bound by the revised T&Cs. These T&Cs supersede and extinguish all previous agreements between users and the Foundation.
